These General Terms and Conditions of Sale (hereinafter “GTC”) apply to all products offered by EARL WALCZAK PERE ET FILS on the website https://champagne-walczak.fr/. By placing an order, the Customer declares that they have read and unreservedly accepted these GTC.

2. Scope and purpose
These GTC govern the sales of products made by EARL WALCZAK PERE ET FILS to its consumer customers.
The Customer acknowledges having read these GTC prior to placing their order. Validation of the order constitutes acceptance without restriction or reservation of these GTC.
EARL WALCZAK PERE ET FILS reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.
3. Products
sale of rosé Champagne, Rosé des Riceys, Coteaux Champenois and Ratafia Champenois
The products offered are described and presented with the greatest possible accuracy. However, should any errors or omissions occur in this presentation, the liability of EARL WALCZAK PERE ET FILS may not be incurred.
The products comply with the regulations in force in France. The photographs and illustrations presented on the website are not contractual.
4. Price
Prices are indicated exclusive of tax (excl. VAT) in euros. Applicable VAT will be added at the time of the order.
Delivery charges: free from 12 bottles. Delivery charges are indicated before validation of the order.
Offers and prices are valid for an unlimited period, unless otherwise stated.
EARL WALCZAK PERE ET FILS reserves the right to modify its prices at any time. Products are invoiced on the basis of the rates in force at the time the order is validated.
5. Order
The Customer follows the steps below to place an order:
Selection of products and addition to the basket
Verification of the contents of the basket
Validation of the delivery and billing information
Reading and acceptance of the GTC
Confirmation and payment of the order (“double-click”)
The sale is definitively concluded once the order confirmation has been sent to the Customer by email. EARL WALCZAK PERE ET FILS reserves the right to refuse any order in the event of a prior non-payment, insufficient stock or suspected fraud.
In accordance with article 1127-1 of the Civil Code, the contract is archived and accessible on request from EARL WALCZAK PERE ET FILS. These GTC are drawn up in French. In the event of translation, only the French version shall prevail.
6. Payment
The accepted means of payment are: bank card, bank transfer.
Payment is due at the time of the order. Collection is carried out at the time the order is validated.
Transactions are secured via Payplug. The Customer’s bank details are encrypted and are never stored on our servers.
7. Delivery
The products are delivered within the following zone: mainland France.
The indicative delivery time is 3 to 7 days.
Delivery methods offered: carrier, Expedeasy.
In accordance with article L.216-1 of the Consumer Code, delivery must take place within a maximum of 30 days from the order, unless otherwise agreed. In the event of a delivery delay exceeding this period, the Customer may cancel the order under the conditions provided for in articles L.216-2 and L.216-3 of the Consumer Code.
Transfer of risk: the transfer of risk takes place at the time of the physical handover of the product to the Customer (article L.216-4 of the Consumer Code).
In the event of damage or a missing parcel upon delivery, the Customer must lodge reservations with the carrier and inform EARL WALCZAK PERE ET FILS as soon as possible.
8. Right of withdrawal
In accordance with articles L.221-18 et seq. of the Consumer Code, the consumer Customer has a period of 14 calendar days from receipt of the product (or from the conclusion of the contract for services) to exercise their right of withdrawal, without having to give reasons or pay penalties.
To exercise this right, the Customer must notify their decision by means of the withdrawal form below or by any unambiguous declaration to the address: contact@champagne-walczak.fr.
The Customer then has 14 days to return the product in its original packaging and in perfect condition. Return costs are borne by the Customer, unless otherwise provided.
The refund will be made within 14 days from receipt of the returned product or from proof of dispatch, via the same means of payment used when placing the order.
Exceptions: in accordance with article L.221-28 of the Consumer Code, the right of withdrawal may not be exercised for goods made to the consumer’s specifications, goods liable to deteriorate rapidly, unsealed audio/video recordings, and digital content supplied on an intangible medium whose performance has begun with the consumer’s consent.

9. Legal guarantees
All products benefit from the following legal guarantees:
Legal guarantee of conformity
Pursuant to articles L.217-3 et seq. of the Consumer Code, the seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The guarantee of conformity applies for 2 years from the delivery of the goods.
Guarantee against hidden defects
Pursuant to articles 1641 et seq. of the Civil Code, the Customer may request the cancellation of the sale or a reduction in price in the event of a hidden defect rendering the product unfit for its use.

11. Liability
EARL WALCZAK PERE ET FILS may not be held liable for the non-performance of the contract in the event of force majeure as defined by article 1218 of the Civil Code (natural disaster, fire, strike, pandemic, war, widespread computer failure, etc.).
The limitations of liability do not apply in the event of personal injury, gross or wilful misconduct, or where they would constitute an unfair term within the meaning of article L.212-1 of the Consumer Code.
12. Intellectual property
All the elements of the website (texts, images, logos, videos, database, source code) are protected by intellectual property law. Any reproduction, even partial, is prohibited without the prior authorisation of EARL WALCZAK PERE ET FILS.
Retention of title clause: EARL WALCZAK PERE ET FILS retains full and complete ownership of the products sold until full payment of the price, in principal and accessories. In the absence of full payment, EARL WALCZAK PERE ET FILS may claim the return of the products.
13. Personal data
The personal data collected in connection with orders are processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.
The data controller is EARL WALCZAK PERE ET FILS. The data are collected for the processing of orders, the management of the customer relationship and, where applicable, the sending of commercial communications (with consent).

14. Disputes and mediation
In the event of a dispute, the consumer Customer may have free recourse to a consumer mediator:

These GTC are subject to French law.
In the event of a dispute, the consumer may bring the matter before the competent court of their place of domicile or that of the registered office of EARL WALCZAK PERE ET FILS.
15. Final provisions
Should any of the provisions of these GTC be declared null or unenforceable, the other provisions shall remain in force.
The fact that EARL WALCZAK PERE ET FILS does not avail itself of a breach by the Customer of one of its obligations may not be interpreted as a waiver of the obligation in question.
These GTC, together with the prices and descriptions of the products, constitute the entire agreement between the parties.
